We have read with interest, the comments that have been expressed in this forum concerning the IFTA matter. We noted that we could not find any discussion as to the fact that the IFTA applies to 48 out of 50 States and some areas in Canada. If this matter concerning LLC's and IFTA, in California, is not resolved in favor of we RVers, the impact could be substantial.

Perhaps all of us should contact the officers of the RV clubs we belong to and have them present a unified effort to resolve this matter in the RVers favor or as close to the RVers favor as possible.

As always travel safe.

Oh crud, just when I'm thinking of getting an HDT & guess what?? Cali is the state where I planned on going most of the time!!! I wasn't going to be an LLC, just private. Seems Cali is after taxes & fees big time.

Why do you think so many people and businesses are leaving that state? Had a friend who employed 200 people, close down and move to AZ and opened up again with half the people. Slacker!

AZ isn't a cheap state either, it just looks that way next to California!

Next thing you know he'll open up shop in Mexico or move it to China or India. It isn't just that you can get the work done there better, cheaper and by un-tattoed un-pierced workers but that you also get to keep more of what you make and you won't end up being sued and EPA'd out of business.

The problem with these people moving from California is, they take the problems they are running from with them. And then where they move is like where they came from, look at Colorado for an example.

Has anybody else been fined, or heard of someone being fined, since June? I'm beginning to wonder if this was an isolated incident (or incidents) at a single inspection station...

I've been watching for more reports, but there haven't been any... don't know if this is now a dead (or dormant) issue, or if we still need to watch it with the intent to try to do something about it in a grass-roots or legislative way.

Anybody?

The following was also posted on this thread over in HDT.

Kellie and I have been researching this, and as far as we can tell, it does not appear that this is actively being enforced. We have not been able to discover any additional incidents where a private RV operator with an LLC was fined or required to comply to IFTA rules. We did ascertain that the law exists on the books exactly as stated, so the legal framework exists for enforcement, but at this time, no RVers seem to be getting ticketed.

When we first heard about this, we considered starting a grass-roots campaign against it, but one thing we've learned is that such a campaign really puts an official spotlight on the issue. Are we better off leaving it alone since no one seems to be getting hassled? Or should we raise a stink, and possibly fail to get the law changed, but because of the attention, force it into 100% enforcement? At this time, we have adopted a wait/see stance.

If anyone has been personally fined or harassed by CA over this, please let us know, so that we can get a better feel for how much enforcement is actually taking place. A post several months ago asking this question did not get any responses, so my feeling is that it is simply not being enforced...

Mark,

I believe you have taken the correct stance on this issue. Others may differ but sometimes it is just better to stay quiet.

Just curious if any more information has come out on this issue.

This coming summer, the DW and I will be looking towards our nexct duty station and Central CA is unfortunately on the top of the list for assignments.

Anyone given any thought to "renting" their LLC's RV with a similar set of documents to what the 800-rent rv outfitters use? Seems like a valid way to not only deal with the LLC being kept seperate from ther indivdual, but I'm wondering if this will also address the problems some insurance companies have with LLC titled vehicles for coverage.

Any residual legal issues you think this may cause? It would be a quiet way to cover oneselvf without attracting the attention of the CA legislature to take up stronger enforcement as Mark mentioned earlier.

Hi Dave

It's still on our watch list, but we haven't heard anything nor seen any postings online about any additional enforcement since last summer...

We have just crossed the state off of our want to visit and spend time and money in. As far as I can see we don't go where you are not wanted. Seems to be the opinion of many folks that I have talked to on this trip. We are currently in Casa Grande, AZ.
